Privacy policy

This policy explains what personal data Fondeobot LLC handles, which channel it arrives through, what it is used for and what rights you have over it.

It applies to anyone who writes to us and to anyone who buys the software. It is written to Regulation (EU) 2016/679, the General Data Protection Regulation.

Who is responsible for your data

The controller is Fondeobot LLC, of 2458 Maple Ridge Drive, Suite 300, Wilmington, DE 19801, United States, contactable at fondeobot@fondeobot.com.

What we collect, and through which channel

This site has no contact form and collects nothing on its own. It is a static site: browsing it sends us no information about you. It sets no cookies either, as the cookie policy explains.

We handle data only when you write to us, and only through these channels:

  • Email. Your email address and whatever your message contains.
  • WhatsApp. Your phone number and whatever the conversation contains. WhatsApp is a service run by Meta, a third party with its own privacy policy, which we do not control.
  • Telegram. Your username or identifier in the app and whatever the conversation contains. Telegram is a service run by a third party with its own privacy policy, which we do not control.

If you buy the software, we also handle the identification and billing details you give us to complete the purchase, and the technical details we need in order to install and configure the bot and give you access to the signals channel.

We do not ask for, and do not want, the credentials to your bank account, or any special category of data. We do not profile you and we take no automated decisions about you.

Why we use it, and on what legal basis

  • To answer your questions before you buy. Legal basis: steps taken at your request before entering into a contract (Art. 6(1)(b) GDPR) and, where the question is not aimed at buying, your consent in writing to us (Art. 6(1)(a)).
  • To perform the contract if you buy the software: delivering the bot, installing and configuring it, giving you access to the signals channel, providing the VPS, technical support and updates. Legal basis: performance of the contract (Art. 6(1)(b)).
  • To meet legal obligations on accounting, tax and record-keeping where they apply. Legal basis: compliance with a legal obligation (Art. 6(1)(c)).

We do not use your data for advertising and we do not pass it to third parties so that they can market to you. The only people who see it are the suppliers needed to deliver what you bought, acting as our processors.

How long we keep it

Enquiries that do not lead to a purchase are kept while the conversation is still live and deleted once they are no longer needed.

Client data is kept for as long as the contractual relationship lasts and, once it ends, for as long as the applicable limitation periods for legal liabilities and obligations require. After that, it is deleted.

International transfers of personal data

Read this section carefully: it follows directly from the company being in the United States.

Fondeobot LLC is formed and operates in the United States. That means the personal data of a client or an interested person resident in the European Union leaves the European Economic Area and is handled in the United States, a third country with no general adequacy decision from the European Commission.

When you write to us on WhatsApp, on Telegram or by email, or when you buy the software, that transfer necessarily happens: it is the only way we can deal with you, because we have no establishment in the European Union and handle no data there.

On top of that, WhatsApp — a Meta service — Telegram and the technology suppliers needed to deliver the service may handle data outside the European Economic Area, each of them under its own policy.

United States law may allow public authorities there to reach personal data in circumstances, and with safeguards, that differ from those set out in European law. Decide whether you are comfortable with that before writing to us. If you would rather your data did not leave the European Economic Area, the only alternative is not to send us personal information.

Your rights, and how to exercise them

The GDPR gives you the following rights over your data:

  • Access: to know whether we hold data about you and to get a copy of it.
  • Rectification: to have inaccurate data corrected and incomplete data completed.
  • Erasure: to have your data deleted once it is no longer needed.
  • Objection: to object to our handling of your data on grounds relating to your particular situation.
  • Restriction: to have us pause our handling of it while a dispute is resolved.
  • Portability: to receive your data in a structured, commonly used format, or to have us send it to another controller.
  • Withdrawing consent at any time, where our handling of your data rests on it, without affecting what was lawful before you withdrew it.

To exercise any of them, write to fondeobot@fondeobot.com saying which right you want to exercise. We may ask you to prove who you are. We will reply within the period the law allows.

If you think we have not dealt with your request properly, you can complain to the data protection supervisory authority of the country where you live. In Spain that is the Agencia Española de Protección de Datos.

Changes to this policy

This policy may be updated if the contact channels, the suppliers involved or the applicable law change. The version published on this page when you read it is the one that applies.
